No charges expected in July pedestrian death

Driver not at fault in crash that killed Herndon teen.

Charges are not expected to be filed in relation to the pedestrian death of a Herndon teenager on July 1.

Fairfax County Police  Lt. Thomas Rogers said there are conflicts as to where the pedestrian, Jose Antonio Villatoro, 17, was walking when he was struck on Reston Parkway near Glade Drive in Reston.

'There was nothing to indicate that the driver was being negligent," said Thomas. "Neither speed nor alcohol was involved. It was just an unfortunate accident."

Villatoro, a rising senior at South Lakes High, was hit by a Reston man driving a pickup truck about 9 p.m. that night. He died two days later at Inova Fairfax Hospital.

Rogers said that intersection is not a particularly dangerous one.

"The biggest pedestrian issue we have in Reston are in the Wiehle and Sunset Hills area," he said.

That area contains the intersection of two busy roads, traffic lights that are close together,a crossing for the popular W&OD Trail, and the driveway to the Reston Fire Station. A large number of offices combined with several restaurants and banks means that intersection also has high foot traffic, said  Lt. Rogers.

In 2009, there were 11 cyclist and 18 pedestrian accidents in Reston, Lt. Rogers said. Through May of 2010, there have been three bicycle incidents and five pedestrian crashes.
