Former FCPS Driver Convicted on Porn Charges

Herndon man will be sentenced in May on eight counts.

A Herndon man who was employed as a Fairfax County Public Schools bus driver was convicted of eight counts of possession of child pornography in Fairfax County Circuit Court on Wednesday.

The jury recommended Derrick Nathan Smith serve 180 days in jail.

Smith was not accused of committing any crimes against students or on at work when he was arrested by Herndon Police on Sept. 14, 2010. Smith drove routes for several Reston schools, including South Lakes High School, Langston Hughes Middle School, Lake Anne Elementary School and Hunters Woods Elementary School.

FCPS says Smith was terminated shortly after his arrest.

Assistant Commonwealth’s Attorney Jonathan Phillips said Herndon detectives traced downloads of child pornography to a computer in Smith's home, where they served a search warrant in September 2010.  Detectives found more than 100 child porn files on the computer, Phillips said.

Smith pleaded not guilty to the charges and his attorney, Alfred Robertson Jr., questioned whether he knew the files were on the computer.

Sentencing will be May 18.
